Federal Court declares FC Sion appeal inadmissible

The Swiss Federal Supreme Court has declared inadmissible the appeal filed by FC Sion/Olympique des Alpes against the award of the Court of Arbitration for Sport (CAS) in January.

With an award dated 16 July 2012, and received by UEFA today, the Swiss Federal Supreme Court has declared inadmissible the appeal filed by FC Sion/Olympique des Alpes against the award of the Court of Arbitration for Sport (CAS) rendered on 31 January 2012.

The CAS award had confirmed the exclusion of FC Sion/Olympique des Alpes from the 2011/12 UEFA Europa League because of a sanction of forfeit imposed by the UEFA disciplinary bodies, based on the fielding of ineligible players by the Swiss club in two matches against Celtic FC.

The Federal Supreme Court has considered that FC Sion/OLA do not have any actual, legitimate interest in appealing against the CAS award, so that the appeal was declared inadmissible. Furthermore, the expenses of the procedure were put on the charge of FC Sion/OLA on the grounds that the appeal filed did not seem to have any merit.

With this, the disciplinary sanctions imposed on FC Sion/OLA by the competent UEFA disciplinary bodies and confirmed by the CAS on 31 January 2012 become definitive.
